Terms of Service

Beta notice. MyBimah is currently in active beta with a limited number of synagogues. The service may change, be interrupted, or have features added or removed without notice. We do not provide a service-level agreement (SLA) during beta. Do not use MyBimah as your sole system of record for time-sensitive or irreplaceable information.

1. Acceptance of these terms

By creating an account or using https://mybimah.com or any tenant subdomain (each, the “Service”), you agree to these Terms of Service (“Terms”). If you don't agree, don't use the Service. If you accept these Terms on behalf of an organization, you represent that you have authority to bind that organization, and “you” refers to that organization.

2. The Service

MyBimah is a service-planning platform for synagogues. It includes run-of-service editors, honor planning, member directories, calendar integration, printable service orders, and related features. The exact feature set evolves over time and is not guaranteed.

Some features rely on third-party services (Google Calendar, Sefaria, Hebcal, Resend, etc.). Those services have their own terms, and we don't control them.

3. Accounts and access

Access to the Service is by invitation from your synagogue's administrator (or, for the MyBimah team, by direct provisioning). You agree to:

  • Keep your password confidential and not share your account.
  • Notify us promptly at support@mybimah.com if you suspect unauthorized access.
  • Provide accurate information when creating or updating your profile.

You are responsible for all activity under your account, except where caused by our breach of security on our infrastructure.

4. Customer content

Synagogue data you put into the Service — service orders, member information, honor histories, uploaded logos and documents, announcements — remains your property (“Customer Content”). You grant us a limited license to host, display, transmit, and process Customer Content solely to provide the Service to you.

You represent that you have the right to upload and use the Customer Content, including any personal data of members, volunteers, clergy, or honorees. You are the controller of personal data of your community; we are a processor acting on your instructions.

5. Acceptable use

You agree not to:

  • Use the Service to harass, defame, or harm any person, or to violate any law.
  • Attempt to circumvent authentication, tenant isolation, or rate limits, or scan for security flaws without our written permission.
  • Reverse-engineer, decompile, or copy the underlying software, except to the extent that applicable law expressly permits.
  • Resell or sublicense the Service, or use it to operate a service for parties other than your own synagogue community.
  • Upload malware, harmful code, or content that infringes on others' intellectual property.

6. Intellectual property

The Service's software, design, and brand (including the MyBimah name and logo) are owned by us and our licensors. We grant you a limited, non-transferable, non-exclusive license to use the Service during your subscription. Nothing in these Terms transfers ownership of our intellectual property to you.

We may use de-identified, aggregated usage data (with no Customer Content visible) to improve the Service.

7. Beta service — no warranties

The Service is provided on an “as is” and “as available” basis during beta. We disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement, to the maximum extent permitted by law.

We do not warrant that the Service will be uninterrupted, error-free, or that all defects will be corrected. We do not warrant that the Service will meet any specific reliability, availability, or performance criteria during beta.

8. Limitation of liability

To the maximum extent permitted by law, neither we nor our affiliates, contractors, or licensors will be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, lost data, or business interruption, arising from or related to the Service.

Our total cumulative liability for any direct damages is limited to the greater of (a) the fees you actually paid us in the 12 months before the claim, or (b) USD $100. During free beta, this cap is USD $100.

Some jurisdictions don't allow these limits; in those jurisdictions, our liability is limited to the smallest amount permitted by law.

9. Termination

You may stop using the Service at any time. If you ask us to delete your account, we'll do so within 30 days, subject to our routine backup retention windows (see the Privacy Policy). We may suspend or terminate your access if you materially breach these Terms, or if we discontinue the Service. Where possible, we'll give reasonable notice and an opportunity to export your Customer Content.

Sections that by their nature should survive termination (intellectual property, disclaimers, limitation of liability, indemnity, governing law) survive.

10. Indemnification

You agree to defend and indemnify us from third-party claims arising out of (a) your Customer Content, (b) your violation of these Terms, or (c) your violation of applicable law. We'll tell you promptly about any covered claim and let you control the defense, provided you act reasonably and don't settle in a way that admits our liability without our consent.

11. Changes to these Terms

We may update these Terms from time to time. If a change is material — especially anything that affects your rights or increases your obligations — we'll give you reasonable notice (typically by email to your account address, or a banner on the Service) and a chance to review before the change takes effect. Continued use after the effective date means you accept the updated Terms.

12. Governing law

These Terms are governed by the laws of the State of Georgia, United States, without regard to conflict-of-laws rules. Any dispute will be resolved in the state or federal courts located in Fulton County, Georgia, and you consent to the personal jurisdiction of those courts.
